Conditions of Entry

1. Information about how to enter and prizes forms part of these Conditions of Entry. Entry into the "Describe a situation where you wished you had Kleenex Flushable Fresh Wipes on hand" Promotion (Promotion) is deemed to be an acceptance of these Conditions of Entry.
2. The Promotion commences 12:00 AEST Monday 20 October 2008 and closes at 12:00 AEST Monday 12 January 2009 (Promotion Period).
3. Entry is only open to Australian residents. Employees (and their immediate families) of Kimberly-Clark Australia, or agencies, suppliers or companies associated with the conduct of this Promotion, are ineligible to enter.
4. This is a game of skill and chance plays no part in determining the winners.
5. To enter the Promotion (Entry), the entrant must:
   1. Purchase during the Promotion Period any Kleenex Flushable Fresh Wipes 40pk (Purchased Product);
   2. log on to www.kleenexpuppy.com.au (Kleenex Puppy Website);
   3. click on the competition link on the Kleenex Puppy Website;
   4. sign in and register his or her details and the barcode of the Purchased Product on the Kleenex Puppy Website;
   5. complete all the information requested for Entry into the Promotion including a response in 25 words or less to the Promotion question "Describe a situation where you wished you had Kleenex Flushable Fresh Wipes on hand";
   6. consent to the collection, use and disclosure of his or her personal information in accordance with paragraph 29 of these Conditions of Entry;
   7. follow the link on the Kleenex Puppy Website to submit your Entry ­ a confirmation email will be sent to the email address provided in the Entry; and
   8. follow the link in the confirmation email sent to you by the Promoter to confirm your Entry.
6. The Entry must be received during the Promotion Period. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
7. There is a limit of one Entry per entrant per month. However, each Purchased Product may only be used once.
8. All claims and entries are the property of the Promoter.
9. The Promoter takes no responsibility for any lost, stolen, damaged, late or misdirected entries or for any delays or failures in any delivery service or equipment.
10. All entries to the Promotion may be subject to verification by the Promoter. The Promoter may disqualify any entrant for tampering with the entry process, or who submits an Entry that is not in accordance with these Conditions. Any entry made with a stolen, forged, mutilated, unrecognised or tampered with Purchased Product barcode number is void. The entrant must retain his or her original Purchased Product packaging including original barcode to claim a prize.
11. The entrant MUST, within 7 days of being asked, provide to the Promoter (at the Promoter's cost) documents requested by the Promoter to establish eligibility to enter, including Purchased Product packaging, original barcode and evidence of residence or identity. If the entrant does not do so, the Promoter may, in its absolute discretion, declare any or all of the entrant's Entries invalid.
12. All Entries must be the sole work of the entrant. All valid Entries will be individually judged by a panel appointed by the Promoter.
13. All valid Entries will be judged at 10:00 AEST Thursday 15 January 2009 at level 6, 52 Alfred Street, Milsons Point NSW 2061, having regard to the overall quality of the Entry, including creativity, novelty, composition, creative merit and originality. The best entry will win a Westfield Gift Card to the value of $1000. The next best 50 Entries will each win a Kleenex Flushable Fresh Wipes Travel pack valued at $40 each (Winners).
14. The Flushable Fresh Wipes Travel Pack consists of an overnight travel bag set from Cher International, consisting of one overnight travel bag with matching toiletries bag.
15. The Westfield Gift Card must is valid for 12 months from the date it is activated. Refer to www.westfieldgiftcards.com.au for full terms and conditions for the use of the Westfield Gift Card.
16. The total prize pool is up to a maximum of $3,000.00. The value of the prize is accurate and based upon the recommended retail price at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prize after that date.
17. The prize (including any unused portion) cannot be transferred, exchanged or redeemed for cash. The prize must be taken as offered and cannot be varied by a Winner. The Promoter retains the right to substitute the prize with a prize or prizes of equal or greater value (including where a prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.
18. The names of the Winners will be published on the Promotion winner's page on the Kleenex Puppy Website by 17:00 AEST 22 January 2009. Winners will also be notified by email.
19. If a prize is not claimed by a Winner by 1 May 2009, the Winner will forfeit his or her prize. The Promoter may award a forfeited prize to the next-best Entry. The winner of any unclaimed prize will be notified by email.
20. The Promoter's decision is final, and no correspondence will be entered into, including in the event of a dispute.
21. The Promoter reserves the right to validate and check the authenticity of Entries and to disqualify any entrant who tampers with the Entry process, or who submits an Entry that is not in accordance with these Conditions of Entry.
22. The Promoter and its associated agencies or companies accept no responsibility for any lost, late, stolen, damaged or misdirected Entry.
23. The Promoter has no control over internet or mobile telephone communications, networks or lines, bugs, viruses and server problems and accepts no responsibility for any problems associated with them, for any reason.
24. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the prizes and these Conditions of Entry, subject to approval of the gaming authorities in each State and Territory where relevant.
25. All tax liability arising as a result of accepting any prize is the responsibility of the Winner.
26. The Promoter and its agents will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize except for any liability which cannot be excluded by law.
27. If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Conditions of Entry, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.
28. All claims and Entries become the property of the Promoter and all copyright in the Entry is transferred to the Promoter. By entering this Promotion the entrant consents to the Promoter and the Promoter's agents, licensees and assigns infringing the entrant's moral rights in any works in the entrant's Entry for an indefinite period of time by:
    1. not naming the entrant as the author of a work and naming the Promoter or an employee of the Promoter as the author; and
    2. amending or modifying (whether by changing, adding to or deleting/removing) any part of a work.
29. By entering the Promotion the entrant consents to the Promoter's privacy policy available on the Kleenex Puppy Website. The Promoter collects the entrant's personal information for the purposes of administering the Promotion, notifying and announcing the Winners and of marketing the Promoter's products and services, including by direct marketing techniques. The Promoter may disclose the entrant's personal information to third parties including those involved in the administration of the Promotion, notifying and announcing the Winners, the supply of prizes, fulfilment houses and advertising agencies. If the entrant does not provide the required personal information to the Promoter, the entrant cannot enter the Promotion. The entrant may access and correct the personal information about the entrant held by the Promoter by writing to the Promoter at the address below. By entering this Promotion the entrant consents to:
    1. the collection, use and disclosure of his or her personal information as set out in this paragraph 29;
    2. receiving from the Promoter telemarketing calls for an indefinite period of time, notwithstanding any listing of the entrant's telephone number on the Do Not Call Register; and
    3. receiving from the Promoter commercial electronic messages, including SMS and email messages, for an indefinite period of time.

31. These Conditions of Entry are governed by the laws of New South Wales, Australia.
